Expunction and Nondisclosure in Leander

Texas law allows some criminal records to be cleared or sealed. Expunction under Texas Code of Criminal Procedure Chapter 55 destroys records when a case was dismissed, you were acquitted, or the arrest involved mistaken identity. If you were arrested in Leander and your case qualifies, you file the expunction petition in Williamson County. All agencies then must destroy their copies of the record.

If expunction does not apply, nondisclosure under Texas Government Code Section 411 may seal the record after you complete deferred adjudication. The sealed record is not visible to the public. Waiting periods vary. Some misdemeanors allow immediate filing after completing deferred adjudication. Felony cases require a five-year wait after the probation period ends. Violent offenses, sex crimes, and family violence charges are excluded from nondisclosure.
